TERMS & CONDITIONS

In the following terms & conditions, “the videographer” shall mean Paul Glenn trading as Labyrinth Mini Movies. “The clients” shall be those persons defined as the client. The clients cannot vary these terms & conditions unless the videographer expressly agrees upon in writing such conditions.

1. COPYRIGHT

i. The copyright Designs and Patents Acts assign the videographer’s copyright of the images and videos.

2. DISPLAY

i. The client(s) hereby allow(s) the videographer to display any photograph or video covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, sample albums etc.

3. CREATIVE LICENSE, COVERAGE AND REPRODUCTION

i. Photographs and videos taken during the course of the event will be at the discretion of the videographer, although every effort will be made to comply with the client’s requirements.

ii. Special requests are not binding instruction, although every effort is made to comply with the client’s wishes. The videographer/s will do their best to honour the requested videography but do not undertake to guarantee any specific video nor incorporate any specific background, location or group arrangements due to changes in weather and the availability and willingness of subjects.

iii. For a booking involving a church ceremony or at specific venues, the videographer’s movements are sometimes restricted by the official in charge. The area from which the videographer can cover the ceremony may not be the videographer’s choice. The videographer cannot accept responsibility for any obstructed view should this be the case.

iv. Due to various lighting conditions and the limitations of digital sensors, some colours may alter throughout a set of filming.

v. Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the videographer will not be responsible for videos that are not produced due to technical Failure.

4a. PAYMENT

i. A non-refundable booking fee of 25%, which will confirm your booking, as well as full acceptance of the terms and conditions as published on the videographer’s website. The booking fee will be deducted from the cost of the client’s chosen package when calculating the final balance due. A further 50% payment is required fourteen days before the video shoot, as well as any travel costs identified in the shoot quote.

ii. Payment in full of the remaining balance will be due approximately two weeks after the video shoot and or the final video edits are completed.

iii. Additional goods or services ordered must be paid for in full at the time of ordering.

iv. Titles to all goods remains with the videographer until paid for in full by the client(s)

4b. ONLINE ORDERS

Any order placed by you in the manner described in this website is an offer by you to purchase a particular product for the price (including the delivery and other charges and taxes) specified in this website at the time you place your order on these Terms and Conditions. 

Labyrinth Mini Movies reserve the right to accept or reject your offer for any reason. Including without limitation the unavailability of any product, an error in the price or the product description posted on this website, or an error in your order. Your contract with us only comes into existence when it forwards confirmation of receipt of your order and payment.

5a. FORCE MAJEURE

i. In the improbable events of cancellation by the videographer or of total video failure, liability shall be limited to a full refund of any fees paid, excluding any travel fees paid.

ii. The videographer will endeavour to put the client(s) in touch with another videographer if they are unable to attend due to any cause beyond their reasonable control. E.g. sudden illness, injury, a victim of crime, flooding, traffic conditions, vehicle breakdown etc.

5b. FAILURE TO PAY THE OUTSTANDING INVOICE(S)

i. The digital video files captured and used to create a video production are often huge in size, taking up expensive storage space on our servers. If full payment can not be made in a reasonable time for any reason, the client will be reminded three times of the outstanding invoice(s). If full payment can not be made at this point, all digital files will be permanently deleted from our servers. Please note once this is done, all files will be lost forever, so we encourage prompt payment of all invoices.  

6. DIGITAL VIDEO FILES

i. All digital negatives (computer files) remain the property of the videographer.

ii. Should the digital video files be lost, damaged or destroyed for reasons beyond control, the videographer’s liability shall be limited to a full refund of any deposits and fees paid but shall not include a refund for any goods already received.

7. ON THE DAY

i. The videographer will be the sole professional (video) videographer at the venues specified. However, the videographer does positively encourage family, friends, and other guests to take videos throughout the day.

ii. The videographer will not take videos during the wedding breakfast and will use this time to take a break. A meal is not a requirement; however, one would be greatly appreciated.

iii. When a full day package has been purchased, the videographer will stay to video beyond the first dance stay until approximately 8:30 pm. Any videography following this time will be at the discretion of the videographer or if expressly agreed in writing beforehand.

8. PERSONAL ACCIDENT

i. Any directions issued to clients, their guests or employees during a video shoot are deemed to be at said persons own risk. The videographer cannot be held responsible for any personal accidents during a video shoot.

9a. CANCELLATION FEES

i. If the client(s) should have to cancel a booking, the following cancellation fees will become due immediately upon said cancellation:

ii. Cancellation from the booking date and more than two weeks to go until the wedding, the booking fee.

iii. Cancellation with less than two weeks to go until the wedding date, the total price for the complete video coverage booked. The client(s) are hereby advised to take out an appropriate insurance policy to cover any expenses incurred in the event of cancellation.

9b. REFUNDS

We hope you will be pleased with your purchase. Should you wish to return anything bought from us, we will be happy to refund or exchange a product provided it is in a fully resalable condition. Returns should be made within a resalable time (14 days) and in original, undamaged packaging. If we find that the product has not been returned to us in fully resalable condition, we reserve the right to refuse a refund on the item. If you are returning an item because of an error on our part or because it is damaged or defective, we will refund the delivery charges incurred in sending the item to you and pay your costs of returning it to us.

10. DELIVERY

i. The videographer will endeavour to deliver digital video files as quickly as possible, typically 2-4 weeks. However, this could take 4-6 weeks or even longer during busy periods.
